Anna Nicole Smith's Autopsy Began This Morning At 9:20 A.M. Eastern

A day after Anna Nicole Smith's death, her autopsy will be conducted, as will an emergency hearing to decide whether a court-ordered DNA sample can be taken from her body to help determine the biological father of her daughter, Dannielynn.

The attorney for photographer Larry Birkhead, who claims he is Dannielynn's father, requested the closed-door hearing, which is expected to start around 9 a.m. before Los Angeles Superior Court Judge Robert Schnider, the county's presiding family court judge.

Birkhead's attorney, Debra Opri, said her DNA experts insist that, to get a good sample, they have to obtain some of Smiths's DNA within 48 hours of her death. She emphasized that Birkhead did not ask for the hearing and is devastated, having lost "the love of his life and the mother of his child."

Birkhead, 34, has long contested the claim that 5-month-old Dannielynn was fathered by Smith's companion, attorney Howard K. Stern, 38.

It is unclear how a DNA sample would be taken from the infant, who, according to Opri, is currently under the care of the mother of the Bahamas' Immigration Minister, Shane Gibson.

Meanwhile, Edwina Johnson, chief investigator for the Broward County Medical Examiner's Office in Florida, where Smith died, said her cause of death was under investigation and an autopsy would be done today.


Smith had been due to arrive Saturday night for a pre-Super Bowl celebrity poker tournament. Instead, she arrived Monday, feeling sick, with a nurse, a bodyguard, Stern and two other unidentified people.

According to a Bitner, Smith was in town to buy a boat.

Bitner said Smith had stayed at Hollywood, Fla., a casino resort at least three previous times: to film a TrimSpa commercial, celebrate a birthday and attend a boxing match with her friend, boxing promoter Don King.

How did she die?
Unknown. An autopsy Friday and a toxicology test will ultimately decide cause of death. Smith had battled health problems recently and there was a nurse in the hotel room with her. It's not known why the nurse was there, but Smith was hospitalized in November for pneumonia and suffered flu-like symptoms before her death. Also, Cyril Wecht, the Smith-hired pathologist who believed Smith's son died of a combination of medication and a heart condition, says that Smith could have had the same heart problem.

What's the status of the inheritance?
It had been looking good for Smith. She claimed her late husband, oil billionaire husband J. Howard Marshall II, promised her millions. After he died in 1995, she tangled with Marshall's son. A California bankruptcy judge awarded Smith $474 million, later overruled by a federal judge who reduced it to $88 million. An appeals court then ruled she was entitled to nothing because the federal courts lacked jurisdiction in a matter that should be handled in Texas state court. But the Supreme Court recently overturned that decision, and allowed lawyers to go the next round in federal court, which is where the case stands.

Would Dannielynn get the inheritance?

Unknown. As Smith's only surviving child â€" son Daniel died three days after Danielynn's birth â€" the daughter is theoretically entitled to most if not nearly all of Smith's estate, including any inheritance. Smith's death, however, throws the already tangled inheritance fight into chaos. Also, it's still unknown whether Smith had a will, and, if so, what provisions she made for her daughter. If she died without a will, by law everything would go to Dannielynn. The matter likely will be tied up in courts for years.

Were Howard K. Stern and Anna Nicole Smith ever legally married?
No. They had what they called a "commitment ceremony" on Sept. 28 in the Bahamas, but it was not legally binding under Bahamian or American law. "They were partners, soul mates," says Smith's lawyer.

Who is Dannielynn's father?
Unclear. Both Stern and photographer Larry Birkhead, a former boyfriend of Smith's, claim paternity. Just the day before Smith's death, the judge in a suit brought by Birkhead ordered DNA tests of Smith and the baby to determine the father. Shortly after she died, Birkhead's lawyers sought an emergency order to have DNA taken from Smith's corpse, which Smith's attorney denounced as "the lowest form of behavior one could imagine."

Who will have custody of Dannielynn?

For now, Stern. The question of custody is intertwined with paternity, and the courts will ultimately decide. Currently, Stern considers himself the father and is maintaining custody of the baby, though at the time of Smith's death, the child was in the Bahamas with friends of Smith.

Was she taking drugs at the time of her death?
Yes, flu medication, according to a source. The toxicology test will determine whether she had been taking any other legal or illegal drugs. Smith also was under a psychiatrist's care, but it wasn't known whether she was taking drugs as part of her treatment.

Why was she in Florida?

Apparently for vacation. Police say she was a "frequent patron" of the Hard Rock Hotel & Casino in Hollywood, Fla., and had shot a TrimSpa video there last year. She had checked in on Monday and was scheduled to leave on Friday.

Is Stern a suspect?
Not identified. Police have not even determined if there was foul play, much less identified anybody as a suspect. Stern had gone to Florida with Smith, but police have not disclosed whether he was in the hotel room with her when she collapsed.

How does this affect the investigation into her son's death?
It doesn't. Bahamian authorities will go forward next month with the inquest into 20-year-old Daniel's death last September. Authorities want to hear from Stern, who was present during Daniel's death and was also with Anna Nicole during her trip to Florida.

New Details On Anna Nicole Smith's Death

Anna always seemed like such a free spirit and she really adored her son. She will be missed by many.
Updates:

Chief Charlie Tiger of the Seminole, Florida police department, in a press conference this afternoon, said that Ms. Smith's personal nurse called the hotel operator, who then called 911, at 1:38 p.m.

Law enforcement and paramedics responded to a call for medical assistance at the Seminole Hard Rock Hotel, he said, at 1:45 p.m. A bodyguard had administered C.P.R., Chief Tiger said, before paramedics took the scene.

At 2:49 p.m., police were informed by hospital personnel that Ms. Smith had passed away. It's unclear if this was the official time of death, or just when police were informed.

There was no immediate information on why Ms. Smith had a nurse with her.

A press conference that was originally scheduled to be held at the hospital has, according to CNN, been called off, at the request of Ms. Smith's family, who asked that questions be directed to attorneys.

Ms. Smith's body was being transferred to the Broward Medical Examiner's office this afternoon.

A legal matter is likely to emerge over custody of Ms. Smith's 5-month-old daughter, Dannielynn. Two men have both claimed to be the father: Ms. Smith's personal attorney Howard K. Stern (whom Ms. Smith maintained was the father); and an ex-boyfriend, Larry Birkhead, a photographer. Mr. Birkhead filed a lawsuit contesting Mr. Smith's claim as father in October.

A sizable fortune may be at stake in whoever is determined to be the father of Dannielynn, who is currently in the Bahamas being cared for by friends.

A court has ordered a paternity test, which was delayed multiple times by Ms. Smith's attorneys, according to press reports. Just this week, a Los Angeles judge established Feb. 21 as a final deadline for the test.

Ms. Smith's Web site, AnnaNicole.com, was overwhelmed with traffic this afternoon, as visitors attempted to visit the page. Meanwhile, the E! Network, which was home to Ms. Smith's short-lived and critically decried reality television program, "The Anna Nicole Show," issued a statement:

"E! Networks is deeply saddened by the tragic news. Our thoughts are with her family and loved ones."

The show only lasted through 2004, and was initially one of the highest-rated programs on the E! Network.

Britney Spears Denies Having Lesbian Orgies

As if she'd admit to it in the first place?! This was a non-issue for me and this ain't no revelation or defense. But, here ya go.

Gina Orr, Britney Spears' spokesman for her record label Jive, made a very lengthy, prominent and bold speech last night to ensure the world that lesbian allegations are not true.

A source close to Spears said: "This is all part of a plan to smear Britney. They are close to agreeing a divorce statement - so this is a warning shot if he doesn't get what he wants."

Anna Nicole Smith Dies?!!


Reality TV star and former model Anna Nicole Smith was pronounced dead Thursday after being taken to a Florida hospital, a law enforcement source told CNN.

Smith, 39, collapsed at a south Florida hotel, according to news reports.

"I can confirm that she is deceased. It's as shocking to me as to you guys," Smith's attorney, Ronald Rale, told Reuters. "I don't know anything further. [Her lawyer and husband] Howard [K. Stern], obviously, is speechless and grieving."

Smith's nurse called Seminole Hard Rock Hotel workers at 1:38 p.m. and security went to the room, hotel officials said. Fire rescue workers from both the Seminole Indian tribe and from Hollywood Fire-Rescue arrived minutes later and Smith was taken to Memorial Regional Hospital in Hollywood at 2:10 p.m.

Smith was involved in a paternity suit regarding the parentage of her daughter, Danielynn, as well as other disputes, including some regarding a house she stayed at in the Bahamas around the time she gave birth.

Earlier this week, Smith was included in a class-action lawsuit against a company, TrimSpa, for which she had worked as a spokesperson. TrimSpa makes a product it claims leads to substantial weight loss. The lawsuit alleges the marketing of the product, TrimSpa X32, was false or misleading.

Smith's son, Daniel Wayne Smith, died at age 20 just days after the birth of Smith's daughter. Pathologist Cyril Wecht said a lethal dose of methadone and antidepressants caused cardiac dysrhythmia, leading to his death.

Attorneys for Kim Kardashian plan to file a legal claim in an effort to prevent the release of the DVD featuring Kardashian and her former boyfriend, singer Ray J.

Kardashian, 26, a longtime pal of no-stranger-to-homemade-porn Paris Hilton, confirmed the tapes' existence, but insists she has "nothing to do" with them being made public.

 

Kardashian says she's "hurt and embarrassed" about the prospect of the tape being made public. She added that she will be issuing a statement about developments to prevent a planned DVD release. She plans to take legal action as soon as today.

Kardashian, an LA-based stylist and stepsister of The Hills star Brody Jenner, briefly dated Nick Lachey in 2005 and is most recently linked with actor Nick Cannon.
