John Agnesini, 26, a magazine designer from New York, claims that he bit into a Subway sandwich and found a knife baked inside of the bread.

Agnesisni filed a lawsuit in Manhattan state court Wednesday, he is seeking $1 million in damages.

He says that after taking a couple bites out of the sandwich he saw a 7-inch blade peeking out of his foot-long “Cold Cut Trio” sandwich.

“If I didn’t look at it, I don’t know what would have happened,” said Agnesini. “That’s the last thing you think about a sandwich you eat all the time.”

He claims a colleague called Subway about the incident but that Subway never responded or contacted him.

Subway spokesman Kevin Kane said in a statement,

“At Subway restaurants, we take food safety and customer comments very seriously. We are aware of the complaint made and are investigating the facts alleged. As a pending legal matter, we cannot discuss this matter further.”

Agnesini’s lawyer is looking into whether the June incident may have been intentional or malicious.
