Halle Berry is heading down the aisle for the third time. Her current boyfriend, French actor Olivier Martinez, confirmed their engagement when discussing the opening of his new restaurant Villa Azur to Miami.com, exclaiming, “Yes, of course we’re engaged!”

Olivier also nixed rumors about Halle’s engagement ring, saying that the jeweler taking credit for making her ring is lying. It was designed by a Parisian jeweler named Robert Mazlo. Good to know?

According to Us magazine, before Halle met Olivier, she had given up on marriage (even with stud muffin model and baby daddy Gabriel Aubry), but Olivier “makes her feel safe.” That’s always a good thing when it’s not absolutely boring. Still, they seem happy enough together and I wish them the best. Congrats!

In case you haven't noticed, Halle Berry is a batsh!t crazy control freak. After Halle and Gabriel Aubry ended their relationship, Halle became very possessive over Nahla, saying that Gabriel is racist, endangers their child, and physically attacks folks. Aubry has been in and out of court because Halle is psycho, and now he's had enough.

Every dumb lawsuit that Berry files against her ex gets dropped. Just days ago, the Department of Children & Family Services found no basis to Halle's claims that Gabriel physically or emotionally abused Nahla. Gabriel no longer has to have monitored visitation with his daughter.

A source says: "If he gets dragged in again over baseless claims, that are found to be unsubstantiated and lacking evidence, he will sue her. Gabe has had enough and is extremely frustrated with Halle."

Meanwhile, Gabe has had "many offers to write books and give interviews in exchange for a big payday, but he has turned them all down." So he's not the villain that Halle is painting him out to be?!

"Gabe always thinks of his daughter when making any decision. Halle should count her lucky stars that her ex is being a gentleman, especially under these circumstances."

The source adds: “If Halle truly had the best interests of their daughter in mind she would work with Gabe to co-parent and raise Nahla."

Gabriel Aubry is Halle Berry's colossal douche of a baby daddy. You may have forgotten about his fits of rage during the couple's original custody dispute (including reports that Gabriel repeatedly dropped the n-bomb and insisted that his daughter is not black) but Halle certainly hasn't. She'll appear in court today to request an order of protection from Gabriel, and demand that he be stripped of all visitation rights.

Halle's request stems from a recent incident in which Gabriel allegedly violently mistreated a nanny hired by the couple and neglected daughter, Nahla. The nanny claims Aubry shoved her through a doorway while she was holding Nahla and degraded her in a number of bizarre ways, such as forcing her to sit in a corner until her services were needed. She also claims she witnessed several possibly criminal acts of negligence, such as when Gabriel refused to treat a skin rash found on the child.

Child Protective Services is conducting an investigation, but in the meantime, Halle is asking that the judge tell Gabriel to stay the hell away from her and her daughter. Sounds like she shouldn't have much trouble pleading her case.

Richard Franco made a deal with prosecutors today. Halle Berry's stalker plead no contest to felony stalking charges in exchange for having a felony burglary charge dropped.

Richard was arrested outside Halle's home last year. He has already served 193 days in jail which means he only has another 193 left!

He has been sentenced to 5 years probation after he completes his sentence and must complete a one-year psychological counseling program.

He must remain 200 yards away from the actress from the next 10 years.

Reporters these days are so thirsty! People magazine wrote that Halle Berry and Olivier Martinez is engaged, printing a "confirmation" from a jeweler, but it turns out that Olivier just gifted Halle with a ring.

Halle's jewelry is NOT an engagement ring, sources close to the couple tell TMZ.

Halle and Olivier are in a "committed relationship" and they may marry, but for now they are not engaged. Damn.

Halle Berry has tried her hand at marriage a couple of times in the past, with pretty horrific results, but it seems she's gonna give it another go, this time with fellow actor and boyfriend of one year Olivier Martinez.

Sources confirm that Martinez popped the question over the holidays and Halle said yes, despite having sworn off marriage after her previous two attempts with David Justice and Eric Benet.

Halle and Olivier met on the set of Dark Tide last year, just weeks after Halle's split with model Gabriel Aubry, with whom she is still involved in an ugly custody battle involving the couple's three year-old daughter, Nahla.

So, yeah, it's safe to say love has not been kind to Ms. Berry. Here's wishing her better luck this time around. Congrats!

Halle Berry celebrated her 45 year-old hotness by running around on the beach in Malibu over the weekend.

Halle's daughter Nahla was there, and the actress looked like she really enjoyed herself. Halle has a body better than 25 and 20 year-old chicks. We need to hurry up and move forward with stem cell research and cloning sh!t cause one could "want to" look like Halle or lose some weight, but this woman has obviously been blessed in the genes department.

Halle Berry took Gabriel Aubry to court yesterday and walked out victorious when the judge granted her permission to take Nahla to NYC with her while she shoots 'New Year's Eve.' Halle dropped out of the movie last month to battle Gabriel in court and her part was given to Katherine Heigl, so Halle will be given another role.

TMZ reports Gabriel was being a jerkoff over Halle traveling to New York to shoot the movie, and basically gave her an ultimatum to either do her thing and make her money or stay with the baby. He didn't want Halle taking Nahla to NYC with her.

Gabriel Aubry told Halle he would not let her take Nahla to New York City to shoot a movie.  We're told Halle agreed to put Gabriel up in a fancy hotel during the 1-week shoot so he could be with the kid, but he said no. Gabriel, who isn't working right now, responded this way: "Why do I have to follow her?  She can leave [Nahla] here."

A Los Angeles County Superior Court judge ruled Wednesday that Halle could take the baby with her. 

Friends of Halle say Gabriel knew what he was getting himself into when he sperminated her, and he's just acting out of spite. Halle has other movies in the works, and she expects Gabriel will keep causing problems.

She picked the wrong dude to fertilize her baby maker.

After making each other look like complete tools in the media, Halle Berry and Gabriel Aubry have made amends for the sake of their daughter, Nahla. I'm guessing Halle realized she was coming off looking like a total loon with all of the Gabriel bashing she's done in recent weeks. I think we were one story away from Halle claiming Gabriel started the KKK and used to hold weekly klan meetings in the home they shared together. Gabriel is no saint, but I don't think he's as evil as he has been made out to be.

"I think Halle started realizing that things were getting out of control. It was just getting too nasty and too public."

"Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up till now."

Halle Berry appears on the cover of the new issue of Ebony, and judging from the interview inside, the subject of her daughter's race was on her mind even before the recent ugliness with Gabriel Aubry began.

"I feel like she's black," Halle told the mag. "I'm black and I'm her mother and I believe in the one-drop theory. I'm not going to put a label on it. I had to decide for myself and that's what she's going to have to decide. That's how I identified myself. But I feel like she's black."

This interview took place before Gabriel's alleged comments about his daughter's race and from the sound of Halle's comments, I'm guessing it's a topic that had been on both their minds well before the custody battle. If Gabriel really said what people are saying he said, then he's a colossal jackass. However, I also think it's weird that Halle is so insistent that her daughter be thought of as black. She goes on about not putting a "label" on it and letting the kid decide for herself, but it doesn't sound like she's allowing that to happen.

At the end of the day, two adults are arguing about the race of a two year-old in 2011. Sounds like they both need to grow up and get with the times. Besides, the kid is guaranteed to grow up 100% rich, which matters a hell of a lot more than what box she checks on her census forms.
